1. Seller identity and contact details

See Legal Notice.

2. Purpose, scope and acceptance

These Terms govern distance sales of jewellery and accessories on the website between Magmei and consumers. They are made available before an order is placed. Confirming an order after access to the Terms constitutes acceptance of the version then in force. The customer may download or retain them, and the accepted version must also be supplied on a durable medium with the order confirmation.

The French version is the contractual reference text. This translation facilitates understanding. French law does not deprive consumers resident elsewhere of mandatory protections applicable to them.

3. Product characteristics - natural stones and artisanal production

Every natural stone is unique. Colour, shade, veining, inclusions and transparency may vary from one piece to another and differ slightly from photographs. Where those variations remain consistent with the stated description, dimensions, stone and quality, they are part of the stone's natural character and are not a lack of conformity.

Artisanal production may also result in slight differences in texture, patina, weight or dimensions within stated tolerances. These differences never excuse an incorrect stone, metal or ordered size, insufficient structural integrity, an unstable stone, a defective clasp or any actual lack of conformity.

Images are prepared to represent products faithfully, but colour display varies by screen and lighting. Customers must review the product page, including dimensions, materials, finishes, care and availability, before ordering.

4. Prices, taxes, promotions and free delivery

The applicable prices are those displayed when the order is placed, in the offered currency and inclusive of taxes where VAT applies. Delivery charges and, for destinations outside the European Union, any import duties, taxes or charges are displayed or handled according to information provided before payment.

Standard delivery is free in metropolitan France for orders of at least EUR 150 after discounts and excluding delivery charges. Unless stated otherwise, express delivery is excluded. Temporary offers, promotional codes and gifts are subject to the conditions displayed with the offer and are not retrospective.

Magmei may correct a manifest pricing error before dispatch. Where the displayed price is obviously derisory compared with the normal price, Magmei will contact the customer and cancel with a full refund if the corrected price is not accepted. Magmei will not unilaterally change the price of a validly confirmed order.

5. Orders, contract formation and evidence

The customer selects products and variants, reviews the cart, enters required information, accesses the Terms and confirms an order carrying an obligation to pay. Input errors can be corrected before confirmation.

An electronic acknowledgment is sent. The contract is formed when Magmei confirms acceptance, subject to payment validation and legitimate stock and fraud checks. Electronic records, confirmations, payment data and communications may serve as evidence without excluding any other legally admissible evidence.

Before dispatch, Magmei may suspend or refuse an order for refused payment, reasonable fraud concerns, manifestly inconsistent details, an unresolved prior payment incident, legal inability to deliver or actual unavailability. A cancellation by Magmei results in a full refund and does not create a discretionary right to cancel an ordinary valid order.

6. Payment

Accepted payment methods are displayed at checkout. Payment is secured and processed by Shopify and the offered payment provider. Magmei does not directly retain full card numbers or security codes. No surcharge is imposed solely for using a payment method where prohibited by law.

Goods remain Magmei's property until paid in full. Risk of loss or damage transfers under Article 8 and mandatory law.

7. Availability and preparation

Availability shown on product pages is subject to stock errors and simultaneous sales. For in-stock, made-to-order, pre-order or personalised items, the preparation time and delivery date or period shown before payment prevail. If none is stated, delivery will occur without undue delay and no later than thirty days after the contract is made.

If an item becomes unavailable after ordering, Magmei informs the customer and, where possible, offers a newly agreed delay, an accepted substitute or cancellation and refund. A substitute is never imposed.

8. Delivery, delay and transfer of risk

Available areas, methods, charges and delivery estimates are displayed before payment. A carrier estimate is not an absolute guarantee, but the contractual delivery date or period remains subject to mandatory consumer rights.

No automatic fixed compensation, voucher or commercial gesture is due solely because of delay. Customers retain statutory rights, including requiring delivery within a reasonable additional period and, if Magmei still fails, terminating the contract and obtaining reimbursement within the statutory time. Immediate termination remains available where the law permits, including where an agreed date was essential and Magmei was informed before contracting.

Where Magmei offers the carrier, risk transfers when the customer or the customer's designated third party takes physical possession. If the customer independently chooses a carrier not offered by Magmei, risk may transfer when the goods are handed to that carrier under applicable law.

Customers must provide a complete accessible address. Actual redelivery costs caused by an incorrect address, unjustified refusal or uncollected parcel may be charged after notice. This does not apply where non-delivery is attributable to Magmei or its offered carrier.

9. Receipt, damaged parcel, error or visible defect

Customers should inspect the parcel and jewellery promptly, retain packaging and photograph anomalies. A damaged parcel, wrong or incomplete item, breakage, loose or missing stone, defective clasp or manifestly abnormal finish should be reported promptly to contact@magmei.com with the order number and photographs.

Failure to record carrier reservations or meet an indicative reporting time does not extinguish statutory rights. Where a lack of conformity present at delivery is confirmed, Magmei arranges the legally required repair or replacement free of charge, including necessary return and redelivery costs.

10. Fourteen-day right of withdrawal

Except where a statutory exception applies, customers have fourteen days from the day they or a designated third party other than the carrier take physical possession. For separately delivered goods in one order, the period begins on receipt of the last item.

Customers may withdraw without giving a reason through the online function at https://www.magmei.com/en/withdrawal, the model form in the Appendix, or any unambiguous statement sent before expiry to contact@magmei.com or the seller's postal address. The online function includes confirmation and a durable-medium acknowledgment containing the request, date and time.

After notice, goods must be returned within fourteen days under the supplied instructions. Sale and promotional goods remain eligible unless a statutory exception applies.

11. Return cost, condition and evidence

Metropolitan France. Magmei offers the first withdrawal return per order through a prepaid tracked label, provided the request is timely and items in the same request are grouped. If the customer uses another carrier without prior agreement despite the offered label, those costs are not reimbursed.

Other European Union countries. The customer bears direct return costs. If Magmei offers a label, its exact cost is disclosed before use and may be deducted with the customer's agreement. Magmei bears necessary costs for non-conforming, delivery-damaged or incorrectly sent goods in every served country.

Other destinations. Where sale and delivery are offered, direct return costs and customs formalities are stated before or during the return request, subject to mandatory rights. Non-recoverable duties and import taxes are refunded only where legally required or where Magmei caused the error.

Customers must package jewellery appropriately and retain dispatch evidence. Accessories, certificates and gifts should be returned together where possible. Missing original packaging does not automatically defeat withdrawal, but any actual resulting loss in value may be considered.

Customers may handle jewellery as reasonably permitted in a shop to establish its nature, characteristics and functioning. They are responsible for depreciation caused by excess handling, including prolonged wear, scratches, deformation, impact, contamination, chemical contact, plating alteration, stone damage, alteration, engraving or third-party work. Any deduction is proportionate to documented loss, never a fixed penalty.

12. Exceptions to withdrawal

Withdrawal does not apply to goods made to customer specifications or clearly personalised, including engraving, genuinely bespoke dimensions or a special stone, metal or structure produced exclusively for the customer, where this exclusion was disclosed before ordering.

Artisanal production or choosing a standard website ring size does not alone remove withdrawal rights. A pierced item may be excluded on hygiene grounds only if delivered with a genuine seal, clearly disclosed before purchase, and unsealed after delivery.

13. Refunds following withdrawal

Magmei refunds sums due, including initial standard delivery for withdrawal from the entire order. Any extra cost for a more expensive delivery method chosen by the customer is excluded. On partial returns, initial delivery is refunded only to the extent it would have been lower for retained items.

Refunds are made without undue delay and within fourteen days after notice of withdrawal. Magmei may defer until recovery of the goods or receipt of dispatch evidence, whichever occurs first. The original payment method is used unless another fee-free method is expressly agreed.

Where depreciation can only be assessed after receipt, Magmei documents the condition and may deduct or claim a proportionate amount under applicable law. Refunds are based on the amount paid; any promotion consequences for retained items apply only if clearly disclosed before ordering.

14. Two-year statutory conformity guarantee and hidden defects

All Magmei jewellery benefits from the French statutory conformity guarantee for two years from delivery and the statutory guarantee against hidden defects. A material, manufacturing, soldering, clasp, assembly, setting or surface-treatment defect existing at delivery is remedied free of charge.

A stone loose or missing on arrival, breakage at receipt, a non-functioning clasp or very early abnormal plating failure rather than progressive wear may be covered after assessment. Damage arising within two years is not automatically a conformity defect where objective evidence shows impact, pulling, deformation, misuse or ordinary wear.

STATUTORY INFORMATION - English translation of the French conformity guarantee notice

The consumer has two years from delivery of the goods to invoke the French statutory conformity guarantee if a lack of conformity appears. During this period, the consumer must establish the existence of the lack of conformity, not the date on which it arose.

Where a sales contract provides for continuous digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or service throughout the agreed supply period. During that period, the consumer must establish the existence of the lack of conformity affecting the digital content or service, not the date on which it arose.

The statutory conformity guarantee requires the professional, where applicable, to provide all updates necessary to maintain conformity of the goods.

The consumer is entitled to repair or replacement within thirty days of the request, free of charge and without major inconvenience.

Where goods are repaired under the statutory conformity guarantee, the initial guarantee is extended by six months.

If the consumer requests repair but the seller requires replacement, the statutory conformity guarantee starts again for two years from replacement.

The consumer may retain the goods and obtain a price reduction, or terminate the contract and obtain a full refund against return of the goods, where the seller refuses repair or replacement, the remedy takes more than thirty days, causes major inconvenience, or the lack of conformity persists after an unsuccessful attempt to remedy it.

The consumer may also obtain an immediate price reduction or terminate the contract where the lack of conformity is sufficiently serious. The consumer need not request repair or replacement first in that case.

The consumer is not entitled to terminate the sale where the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

These rights arise under Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller acting in bad faith to obstruct the statutory conformity guarantee may incur a civil fine of up to EUR 300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code for two years from discovery of the defect. This guarantee permits a price reduction where the goods are retained or a full refund against return of the goods.

15. Diagnosis, repair, replacement and excluded damage

Every claim is assessed using photographs, item condition, reported circumstances, impact or deformation marks, wear and, where necessary, workshop advice. Magmei may request return of the item. The assessment is made in good faith on objective evidence and a reasoned response is provided; Magmei does not reserve exclusive power to interpret the contract or law.

Consumers may request repair or replacement. Magmei may decline the chosen remedy where impossible or disproportionately costly compared with the other remedy, as permitted by law and with written reasons. Conformity is restored free of charge, without major inconvenience and within no more than thirty days. Legal price reduction or termination rights remain where repair or replacement is impossible, refused, late, unsuccessful or the defect is sufficiently serious.

The following are not, in themselves, manufacturing defects: micro-scratches or gradual loss of shine; normal plating wear; oxidation or patina compatible with the metal; impact, fall, pulling, twisting or crushing damage; a broken or lost stone after support deformation; exposure to seawater, pools, fragrance, cosmetics, household products or chemicals; care contrary to instructions; unauthorised alteration or repair; loss or theft. This list never excludes an actual defect established or presumed under law.

16. Free twelve-month commercial replating service

In addition to statutory rights, Magmei provides a free commercial replating service distinct from the statutory conformity guarantee.

Price: EUR 0 for an eligible replating operation.

Duration: one request per eligible item, submitted within twelve months of delivery.

Territory: items bought directly from Magmei and delivered to a country served by Magmei. In metropolitan France, Magmei supplies the return label and standard redelivery. From another country, the customer pays tracked postage to Magmei; Magmei pays standard redelivery to the original delivery country, excluding any duties or taxes.

Timing: workshop batches and availability apply; the indicative estimate is approximately one to three months from receipt, confirmed after diagnosis.

How to claim: contact contact@magmei.com with the order number, photographs and a description, then follow return instructions.

The service covers standard replating of an eligible plated item where technically suitable. It excludes stone replacement, structural repair, deformation, breakage, deep scratches, missing components, resizing, a finish different from the original and damage making replating unsafe or unsuitable. Diagnosis precedes work. If it cannot be performed, Magmei returns the item and may offer a separate quotation; no paid work proceeds without agreement.

After twelve months or once the free service has been used, no further free replating is promised. A paid service may be quoted. This commercial service does not affect the statutory conformity or hidden-defect guarantees; an abnormal failure covered by statutory law is handled under Article 14 and is not counted as the commercial replating service.

17. Paid repairs and after-sales service

For uncovered damage, Magmei may offer cleaning, polishing, straightening, clasp replacement, repair, resetting or replating where technically feasible. A quotation states the work, price, transport charges and estimated timing. No paid work starts without express acceptance.

Diagnosis may show that repair is impossible, disproportionate or likely to weaken the item. Magmei may then decline and may, without obligation, offer a separate commercial solution.

18. Care and use

Jewellery should be worn and stored carefully. Remove it for sport, sleep, showering, swimming, cleaning and manual work; avoid fragrance, cosmetics, chlorine, salt, chemicals and impact; store pieces separately and dry. These recommendations do not exclude statutory rights but help distinguish defects from wear or accidents.

19. Liability and force majeure

Magmei remains responsible under applicable law. Nothing excludes or limits mandatory consumer rights, liability for personal injury, gross or intentional fault, or statutory guarantees.

No automatic compensation is owed solely because of delay or an external event. Liability may be suspended or limited under law where an unforeseeable, irresistible external force majeure event prevents performance. Magmei informs the customer and seeks a reasonable solution; statutory termination and refund rights remain.

20. Personal data and intellectual property

Data needed for orders, payment, delivery, returns, fraud prevention and after-sales service is processed under the website Privacy Policy. Website content, photographs, text, designs, marks and other elements remain protected by applicable intellectual-property rights.

21. Complaints, mediation and disputes

Complaints should first be sent to contact@magmei.com with the order number and relevant evidence. Magmei will seek an amicable solution.

The European Online Dispute Resolution platform was discontinued on 20 July 2025, so these Terms do not link to the former ODR platform. Consumers may use any other remedies and competent bodies available under law.

22. Applicable law, courts, amendments and severability

These Terms and Magmei contracts are governed by French law, subject to more protective mandatory provisions applying in the consumer's habitual country of residence. If amicable resolution fails, consumers may use any territorially competent court under applicable rules, including courts at their domicile where permitted.

Magmei may amend the Terms for future orders. The applicable version remains the one accepted for the order and cannot be changed unilaterally after contracting. If a clause is invalid, the remaining provisions continue to the extent permitted by law.
